This Privacy Policy describes how Harber Media (“Harber Media,” “we,” “us”) handles information on the individual property websites we build and operate for real estate listing agents and teams (each, a “Property Site”). It applies to every Property Site on this platform, regardless of which visual theme a given property uses.
The short version: Harber Media builds and runs the website technology. We do not want, and do not receive, the leads a Property Site generates. When you submit a showing request or inquiry, it goes directly to the listing agent or team for that specific property, not to Harber Media. The sections below explain exactly what that means in practice.
Information We Collect
Information you provide voluntarily
If you use “Schedule a Showing” or “Interested in This Property?” on a Property Site, we collect what you enter: your name and email address (required), and, if you choose to provide them, your phone number, a preferred showing date/time, and any message you write. You are never required to browse photographs, floor plans, video, 3D tours, or aerial photography through a form — that content is freely accessible.
Information collected automatically
Like most websites, our servers and hosting provider (Vercel) automatically log basic request information for every visit — for example, IP address, browser/device type, referring page, and timestamps, retained per Vercel’s own standard hosting logs, not a separate Harber Media database. We also record first-party, non-identifying interaction events for the property you’re viewing — for example, that the photo gallery, floor plan, or 3D tour was opened, or that a phone/email link was clicked — so the listing agent can understand engagement with their own listing. The full list of what these events record is: property views; opening the photo gallery or a specific photo; opening the floor plan; opening or launching the 3D tour; playing a video; opening the aerial-photography gallery; clicking a phone or email link; opening or submitting the showing-request or inquiry form; and which marketing source (for example, a QR code) brought you to the page. These events never include your name, email, phone number, or message content, even if you’ve submitted a form elsewhere on the same page — see “Analytics” below for how that separation is enforced.

Where Your Property Inquiry Goes
Information you submit through “Schedule a Showing” or “Interested in This Property?” is transmitted directly to the listing agent or team configured for that specific property, so they can respond to you. That recipient is identified by name in the form itself before you submit. We use a transactional email provider (Resend) to deliver that message; Harber Media is not a To, Cc, or Bcc recipient on it, and there is no Harber Media inbox, dashboard, or database that receives a copy.
A phone number you provide when requesting a showing or submitting an inquiry is contact information for that specific request only. Providing it does not enroll you in recurring SMS/text marketing, and neither the listing agent nor Harber Media adds you to a marketing text list on that basis alone. Any future recurring SMS marketing program would require its own separate, explicit opt-in and legal review — it is not part of this platform today.
If your request cannot be delivered electronically (for example, a technical failure), the Property Site tells you so plainly and offers the agent’s direct phone and email as an alternative. It never shows a false confirmation, and it never falls back to sending your information to Harber Media instead.
Harber Media’s Role
Harber Media is the website/service technology provider for each Property Site — we build, host, and operate the software. We are not the real estate professional responding to your inquiry, and we do not act as one. We process a submission only transiently, and only as reasonably necessary to:
- validate that it’s a genuine, well-formed submission;
- screen for spam/abuse (for example, an automated honeypot field and rate limiting);
- transmit it securely to the configured recipient;
- troubleshoot a technical delivery problem if one occurs; and
- maintain the security of the Property Site and comply with applicable legal obligations.
We do not use the information you submit through a Property Site for Harber Media’s own marketing or sales prospecting, add it to any Harber Media mailing or SMS list, use it to build advertising audiences, sell or resell it, share it for a purpose unrelated to your inquiry, or use one agent’s leads for another agent’s benefit. This is an architectural choice, not just a policy statement: the delivery system has no configuration option to copy a lead to Harber Media, and no Harber-operated database of leads exists.
Who Is the “Business” Responsible for Your Information?
Depending on how a given listing agent or brokerage operates, either the individual agent or their brokerage may be the party legally responsible for information collected on their behalf under California privacy law. This platform is built to support either: every property has a configurable listing agent, brokerage, and lead recipient, so that identity can be set correctly for a given listing without changing how the website works. This policy does not assume the individual agent is always that responsible party.
Analytics
This platform records first-party, operational analytics events so a listing agent can see how their own property site is performing — property views, gallery/floor-plan/3D-tour/video/aerial engagement, phone and email clicks, form opens and submissions, and marketing-source attribution (for example, a QR code scan). These are always recorded and are not gated behind the cookie choice described below, the same way ordinary server request logs aren’t — we treat “how many people viewed this listing” as basic site operation, not third-party tracking.
These events are structurally limited to non-sensitive fields (which media type, which button, which image, which marketing source) — there is no field in this system for a name, email, phone number, or message, and a submission that tried to include one would be rejected outright by the server rather than silently accepted. A successful form submission is recorded as just that: the fact that a submission occurred, plus which property and which button — never what you actually typed into the form.
Advertising Technologies
This platform is built to optionally support Google Analytics, Google Ads conversion tracking, and Meta Pixel on a given Property Site, configured individually per property so one agent’s tracking can never end up on another agent’s listing. As of the date above, none of these are active on any Property Site — no property has a real tracking ID configured, so no such script loads and no data reaches Google or Meta from this platform today.
If a listing agent or Harber Media ever configures one of these for a specific property in the future, it would remain subject to the choice described below: it does not load before you’ve had the opportunity to make a choice, and does not run at all until you affirmatively consent. Under California law, sending information about your visit to an advertising platform like Google or Meta can be considered “sharing” of personal information even though no money changes hands, and we are not asserting otherwise for that future scenario — this is exactly why activation requires your affirmative consent rather than defaulting on. Whatever the configuration, the information submitted through a lead form (your name, email, phone, or message) is never sent to Google, Meta, or any other advertising platform.
Retention
A successful showing request or inquiry is transmitted directly to that property’s configured listing agent or team so they can respond to you. It is not maintained by Harber Media in a persistent lead database — this platform has no production lead store, and nothing about a validated, successfully-delivered submission is kept by Harber Media afterward.
Limited technical and security records may be retained, but only as reasonably necessary to operate, secure, and troubleshoot the Property Site, prevent abuse, and comply with applicable legal obligations. In practice today, that means: if a delivery attempt fails, the only thing kept is a brief technical error message used to diagnose the failure, never a copy of what you submitted; spam/abuse protection tracks a submitting IP address and timestamp in server memory for up to ten minutes to detect repeat automated submissions, and is not written to any persistent store; and standard hosting request logs (see “Information collected automatically” above) follow Vercel’s own retention practices, not a separate Harber Media policy.
Your Privacy Choices
- “Your Privacy Choices” control. A persistent link labeled “Your Privacy Choices” appears in the footer of every Property Site page, at all times, not only on your first visit. It reopens the same choice described below so you can set or change it whenever you want, not only once.
- Cookie/tracking banner. The first time you visit a Property Site (or any time you reopen it via “Your Privacy Choices”), you can choose “Accept” or “Essential only.” Choosing Essential only keeps analytics and advertising technologies off; this choice is stored in your browser and applies until you change it.
- Global Privacy Control. If your browser or a browser extension sends a Global Privacy Control signal, we treat that as an automatic opt-out of analytics and advertising technologies, without needing to ask again — this applies to this platform’s actual data practices as described above.
- California residents generally have the right to request access to, deletion of, or correction of personal information we hold about you, and to opt out of any “sale” or “sharing” of personal information. We do not sell personal information. As described above, no advertising technology is currently active on this platform, so there is currently nothing to opt out of in practice; the opt-out mechanisms above remain available regardless, and will continue to govern any future advertising activation.
